Terms of service
■ Overview
These Terms of Service (hereinafter referred to as "these Terms") define the conditions for using the online store and all associated services (hereinafter collectively referred to as "the Service") operated by PUR POTTERY (hereinafter referred to as "we," "us," or "our shop"). All persons who use the Service (hereinafter referred to as "Users" or "Customers") are deemed to have agreed to these Terms. If you do not agree to these Terms, please immediately cease using the Service.
■ Account, Orders, and Payment (Access and Contract Formation)
● Definitions and Representations
Membership Eligibility: Users represent that they are of legal age of majority in their place of residence and guarantee that their registration information is true and accurate. Account Management: Members are responsible for managing their account information and password. Our shop assumes no responsibility for unauthorized use by a third party except in cases of willful misconduct or gross negligence by our shop. Transfer, loan, or sale of membership eligibility is prohibited.
● Formation, Cancellation, and Refusal of Orders
Contract Formation: A purchase application is made to our shop at the time the User places an order, but the contract is not formed until our shop notifies the User that the order has been accepted. Our Discretion: Our shop reserves the right to refuse to accept an order or to cancel an order already accepted due to insufficient stock, incorrect price displays, suspected legal violations, or other reasonable reasons. Non-cancellable: In principle, cancellations after an order is confirmed cannot be accepted.
● Prices and Payment
Price Display: Product prices are the amounts displayed on the product pages (tax included). In the event of a pricing error, our shop reserves the right to correct it.

■ Shipping, Transfer of Ownership, Returns, and Refunds
● Shipping and Risk of Loss
Shipping Timing: The shipping timing shall be as stated on each product page. Delays may occur relative to the stated shipping timing due to manufacturing processes, procurement status, logistics congestion, weather, disasters, customs clearance procedures, courier convenience, or other reasons beyond our control. Our shop assumes no responsibility for any delays caused by these reasons. We cannot accept cancellations, returns, or refunds due to delays. Transfer of Ownership: Ownership and risk of loss transfer to the User at the time the product is handed over to the courier.
■ Returns, Exchanges, and Cancellations
● Prohibited in Principle
Our shop does not accept any returns, exchanges, or cancellations due to customer preference. The following all fall under "customer preference" and cannot be accommodated: differences in image, size mismatches, mistakes in order details, dissatisfaction with color, texture, or individual differences, growth or condition changes of houseplants, or other reasons based on the User's subjective judgment.
● Exceptions (Reasons Attributable to Our Shop)
We accept returns or exchanges only when reasons attributable to our shop (incorrect delivery, initial defects, quantity discrepancies, etc.) are acknowledged.
● Requirements
To perform a return or exchange, all of the following conditions must be met:

The product must be unused.

The product must be returnable in the same condition as when delivered, including accessories and packaging materials.

An application must be made within 7 days from the date of product receipt using the method prescribed by our shop.

The application must be made with images or other evidence attached that allow confirmation of the defective part.

Returns and exchanges will be permitted only after our shop confirms the defect or discrepancy. Contact for Application: Applications for returns or exchanges shall be made via our shop's designated inquiry form or public email address. Refunds: If our shop determines that the return requirements are met, a refund will be processed using a prescribed method. The eligibility, amount, and method of refund will be determined at the discretion of our shop. Strict Adherence to Deadlines: If more than 7 days have passed, we cannot respond for any reason whatsoever. Shipping Fees and Customs Duties: In the case of returns or exchanges due to customer preference, shipping fees and customs duties shall be borne by the User. In principle, the costs required for return shipping shall be borne by the User.
● Disclaimer (Reasons Excluded from Returns)
Texture or color unevenness caused by natural materials, individual differences or growth changes of houseplants, events corresponding to precautions clearly stated on the product page, and deterioration caused by storage or usage methods are excluded from returns.
■ Personal Information, Privacy, and External Services
● Handling of Personal Information
Our shop handles Users' personal information appropriately in accordance with our privacy policy. Personal information is used for purposes such as order processing, shipping, customer support, marketing, and compliance with laws and regulations. Our shop also handles information obtained through external platforms such as the LINE Official Account (User ID, display name, profile image, message content, form input information, member information, purchase history, etc.) in accordance with this policy. Our shop may entrust the handling of personal information to business contractors (couriers, payment agencies, printing companies, etc.) within the scope necessary. We perform appropriate management and supervision of contractors. Users acknowledge that our shop has separately established procedures for responding to requests for disclosure, correction, suspension of use, etc., of personal information.
● Cookies, etc.
The Service uses cookies and similar technologies. If cookies are disabled, features such as the shopping cart may not function properly.
● External Services
The Service may include links to external websites or integrations with external services. Responsibility regarding the use of external services arises between the User and the external service provider, and our shop assumes no responsibility whatsoever.
■ Intellectual Property, Prohibited Acts, and Posted Content
● Intellectual Property Rights
Intellectual property rights for all content included in the Service (trademarks, logos, images, text, designs, etc.) belong to our shop or the legitimate rights holders. Unauthorized reproduction, republication, modification, or secondary use is prohibited.
● Posted Content (Feedback, etc.)
Regarding reviews, ideas, feedback, etc. (hereinafter referred to as "Feedback") provided to our shop by Users, Users grant our shop a perpetual, worldwide, sublicensable, royalty-free, non-exclusive license to use the Feedback for any purpose, including commercial use. Our shop is under no obligation to monitor, edit, or delete Feedback, but we may take measures such as deletion if we deem it inappropriate at our discretion.
● Prohibited Acts
Acts such as spam, phishing, malware distribution, scraping, access by automated tools such as robots, infringement of others' rights, impersonation, and service disruption are prohibited. If a violation is acknowledged, our shop will take appropriate measures, including account suspension, usage restrictions, and legal action, without prior notice.
■ Disclaimer, Denial of Warranty, Limitation of Liability, Indemnification, Termination, and Governing Law
● Disclaimer and Warranty
Our shop makes no express or implied warranties regarding the Service and products, and provides them on an "as is" and "as available" basis. In particular, we deny implied warranties of merchantability, fitness for a particular purpose, durability, and non-infringement (except where denial is not permitted by applicable law).
● Limitation of Liability
To the maximum extent permitted by law, our shop and our related parties assume no responsibility for indirect, special, or consequential damages (such as lost profits). Except in cases of willful misconduct or gross negligence by our shop, our compensation liability shall be limited to direct and actually incurred ordinary damages, and shall not exceed the upper limit separately established by our shop.
● Indemnification
If a User causes damage to our shop or our related parties due to a violation of these Terms, violation of laws and regulations, or infringement of third-party rights, the User shall indemnify, defend, and hold harmless our shop and our related parties. The indemnification obligation includes reasonable attorney's fees.
● Termination
Our shop may, at our sole discretion, terminate the provision of all or part of the Service or suspend or delete a User's account without prior notice to the User. Even after termination, provisions regarding intellectual property, indemnification, limitation of liability, governing law, etc., shall survive.
● Jurisdiction
These Terms shall be governed by the laws of Japan. For disputes regarding these Terms, the Tokyo District Court shall be the exclusive agreement jurisdiction court of first instance.
